Do You Need a Building Permit for a Carport in Victoria?

If you're planning a new carport in Victoria, one of the first questions to ask is whether you need a building permit.
For most residential carport projects, the answer will depend on the size, height, location and design of the proposed structure, as well as how it relates to the existing home and property boundaries. While some small structures may qualify for a building permit exemption, those exemptions have specific conditions and shouldn't be assumed to apply simply because a carport is freestanding or relatively small.
A residential carport is generally classified as a Class 10a building under the National Construction Code (NCC). From there, the proposed design needs to be assessed against the Victorian building requirements that apply to the property.
It's also important to understand that a building permit and planning permit are different approvals. Depending on the property, planning controls, overlays, easements or siting requirements may need to be considered in addition to the building permit.

In this guide, we'll explain when a carport may require a building permit in Victoria, when an exemption may apply, and some of the other approvals homeowners should be aware of before building.
Does a Carport Need a Building Permit in Victoria?
In most cases, a typical residential carport in Victoria will require a building permit.
There is an exemption under Schedule 3 of the Building Regulations 2018 for certain small freestanding Class 10a buildings. For the exemption to apply, the structure must meet all of the relevant conditions, including:
It must be freestanding.
The floor area must not exceed 10 m².
It must be no more than 3 m high.
If it is within 1 m of a boundary, it must be no more than 2.4 m high.
Where it is associated with another building on the property, it must not be located further forward than the front wall of that building.
It must not be constructed of masonry.
There are additional siting requirements where the Class 10a building is not associated with another building on the allotment.
In practice, most carports designed to provide useful vehicle coverage are larger than 10 m². Attached carports also do not satisfy the freestanding requirement of this particular exemption. This means most of the carports we design and construct require a building permit.
It is also important not to treat the 10 m² exemption as an automatic approval to build. Even where a building permit exemption applies, other requirements may still need to be considered, including planning controls and approvals relating to easements or service authority infrastructure.
Attached vs Freestanding Carports – Does It Affect the Permit?
A common question is whether attaching a carport to the house changes the building permit requirements.
The small Class 10a building exemption discussed above specifically applies to a freestanding structure. This means an attached carport cannot rely on that particular exemption simply because it is less than 10 m².
For a typical attached carport, the proposed connection to the existing house also needs to be properly designed. Depending on the home and carport design, this may involve fascia connections, engineered brackets, connections to the existing building structure or other approved attachment methods.
Freestanding carports are structurally independent of the house, but that does not automatically make them exempt from a building permit. A freestanding carport must satisfy all the conditions of the relevant Schedule 3 exemption for the exemption to apply.
For most practical single and double carports, the roof area will exceed 10 m², so a building permit will generally be required regardless of whether the carport is attached or freestanding.
Builder's tip: Don't choose an attached or freestanding design purely based on trying to avoid a building permit. The better approach is to design the carport around the property, vehicle access, available roof height, existing house structure, drainage and the required setbacks.
Can You Build a Carport Close to the Boundary in Victoria?
Yes, a carport can potentially be built close to a side or rear boundary in Victoria, but being close to the boundary can introduce additional siting requirements.
Under the Victorian Building Regulations, specific rules apply to walls and carports located on or within 200 mm of an adjoining allotment boundary. These rules consider factors including the height and length of the structure along the boundary.
For example, the standard siting provisions generally limit a wall or carport on or within 200 mm of the boundary to a maximum height of 3.6 m and an average height of 3.2 m. There are also limits on how much of the boundary can be occupied, which depend partly on the length of that boundary and existing structures.
If the proposed carport does not comply with the standard siting requirements, this does not necessarily mean the carport cannot be built. Depending on the circumstances, an application for Report and Consent from the relevant council may allow the proposal to proceed. The council assesses matters such as the impact on neighbouring properties and neighbourhood character.
Other requirements can also affect the design, including setbacks from neighbouring windows, the position of existing buildings and any planning controls applying to the property.
Builder's tip: Boundary issues are much easier to identify during the design stage than after a carport has already been quoted or ordered. We check the title, site dimensions, existing structures and proposed carport position before finalising the design so potential approval issues can be identified early.
Do I Need a Planning Permit as Well as a Building Permit for a Carport?
A planning permit and a building permit are two different approvals in Victoria, and depending on the property and proposed carport, you may need one or both.
A planning permit deals primarily with how land can be used or developed. Whether one is required depends on the planning controls affecting the property, including its zone, overlays and any site-specific planning requirements. Planning Victoria specifically notes that permit requirements vary between planning schemes and even relatively minor works can sometimes require planning approval.
A building permit, on the other hand, relates to whether the proposed building work complies with the applicable building legislation, regulations and technical requirements. It is issued by a registered building surveyor and authorises the approved building work to commence.
For a typical residential carport, the process may therefore involve checking:
the property's planning zone and overlays
the Certificate of Title and any restrictions or easements
whether a planning permit already applies to the property
the proposed carport's size, height and location
setbacks from boundaries and the street
whether Report and Consent or another authority approval is required
whether a building permit exemption genuinely applies
Importantly, not needing a planning permit does not automatically mean that you don't need a building permit, and vice versa. Where a planning permit is required, it generally needs to be obtained before the building permit can be issued.
Builder's tip: We recommend checking the planning controls and property documentation before finalising the carport design. This can identify issues such as overlays, easements, existing permit conditions or siting requirements early, rather than discovering them after drawings or materials have been ordered.
What Happens if My Carport Doesn't Meet the Standard Siting Requirements?
If a proposed carport does not comply with one or more of the standard siting requirements in the Victorian Building Regulations, it does not automatically mean the project cannot proceed.
Depending on the requirement involved, it may be possible to apply to the relevant council for Report and Consent. This is a separate approval process that allows council to assess a proposed variation from certain prescribed building regulations before the building surveyor can issue the building permit.
For a carport, Report and Consent may become relevant where a proposal does not satisfy particular siting requirements relating to matters such as:
front setbacks
building height
setbacks from side or rear boundaries
the height or length of a carport constructed on or close to a boundary
impacts on neighbouring properties, such as daylight, overlooking or overshadowing, where applicable
For example, Regulation 80 controls the height and length of walls and carports located on or within 200 mm of an adjoining allotment boundary. Current Victorian guidance confirms that Report and Consent is required where the applicable maximum requirements are exceeded.
Obtaining Report and Consent is not automatic approval. The council assesses the application against the relevant requirements and Ministerial Guidelines before deciding whether to consent to the variation.
It is also important to distinguish this from a planning permit. Report and Consent forms part of the building approval process; it does not replace a planning permit where planning approval is separately required.
Builder's tip: If a carport needs a siting variation, it is usually better to identify this before engineering and final documentation are completed. Sometimes adjusting the carport's position, height or design can achieve compliance without needing a variation; in other situations, Report and Consent may be the more practical solution.
What if My Carport Is Over an Easement or Near Underground Services?
An easement on a property does not automatically mean that a carport cannot be built there, but it can affect the carport design and may require approval from the authority responsible for the easement or underground asset.
Easements are commonly used to protect infrastructure such as sewer, drainage and water assets and to preserve access for the relevant authority. For this reason, the Certificate of Title and available property information should be checked before the carport position and footing locations are finalised.
Where a proposed carport is over or close to an authority asset, additional consent may be required before a building permit can be issued or construction can begin.
For example, Melbourne Water states that written approval is required for works that may affect its assets, and specifically identifies carports as a type of development that can require consent when located near drains, sewers, easements or other Melbourne Water infrastructure.
Approval requirements vary depending on which authority owns the asset, the type and location of the asset, and the proposed structure. Conditions can affect matters such as:
footing locations and depths
clearance from underground assets
whether structural loads can be transferred near the asset
access to the asset for future maintenance
whether the structure needs to be removable
engineering or additional documentation required by the authority
For example, Melbourne Water's current requirements generally do not allow permanent structures over its assets, although certain removable carports with at least three open sides and a flat roof may be considered where the relevant technical requirements are satisfied. Applications are assessed case by case.
This is separate from the normal building-permit assessment. Depending on the property, approval from the relevant water, sewer or drainage authority may therefore need to form part of the overall approval process.
Builder's tip: Check the title and underground asset information before finalising the carport design. Moving a post or changing a footing during the design stage is generally much easier than discovering an authority asset after engineering has been completed.
What Documents Are Usually Required for a Carport Building Permit?
The exact documentation required for a carport building permit will depend on the property, proposed design and the relevant building surveyor. However, a typical application may require a combination of:
Certificate of Title and title plan
Site or allotment plan showing the existing home, boundaries and proposed carport
Carport plans and elevations showing dimensions, heights, roof design and construction details
Structural engineering for the carport, connections and footings
Engineering certification, where applicable
Building permit application documentation
Details of the estimated cost of the building work
Any relevant planning permit and endorsed plans
Report and Consent, where a siting variation requires council approval
Relevant water, sewer, drainage or other authority consent, where required
Additional property or adjoining-building information where it is necessary to assess the applicable siting requirements
The Victorian Building Regulations prescribe information that must accompany building permit applications. For example, Regulation 25 requires particular information to be shown on the allotment plan, including relevant site and adjoining-property information.
The building surveyor then assesses the application against the Building Act 1993, Building Regulations 2018 and National Construction Code and may request further information where necessary.
There is another detail worth mentioning: the building permit application must include the cost of the building work, including labour and materials, because this is used in determining the applicable Building Permit Levy. The requirements for calculating and providing this information were updated from 26 November 2025.
Builder's tip: Getting the site information right at the beginning can save considerable time later. We prefer to identify boundaries, easements, existing structures, attachment points and potential approval issues before the carport drawings and engineering are finalised.
Who Organises the Building Permit for a Carport?
A building permit in Victoria is assessed and issued by a registered building surveyor. The building surveyor independently assesses the proposed work against the Building Act 1993, Building Regulations 2018 and National Construction Code, and is also responsible for the required building inspections and final certification.
For domestic building work under a domestic building contract, there is an important distinction between coordinating the permit process and appointing the private building surveyor.
The homeowner is responsible for appointing the private building surveyor. Victorian law does not allow the builder carrying out domestic building work under a domestic building contract to appoint the private building surveyor on the owner's behalf. An owner can authorise another appropriate person, such as a building designer or architect, to act as their agent, but the builder cannot make that appointment in these circumstances.
That doesn't mean the homeowner has to manage all the technical documentation themselves.

Builder's tip: When comparing carport quotations, check exactly what is included under terms such as “permits” or “approvals.” A lower initial carport price may not include drawings, engineering, council applications, authority approvals or building surveyor fees, which can significantly change the total project cost.
How Long Does a Carport Building Permit Take in Victoria?
There is no single timeframe that applies to every carport building permit. The total approval time depends on the complexity of the project, whether all required documentation has been provided and whether any additional council or authority approvals are needed.
Under the Victorian Building Regulations, once the relevant building surveyor has received the required information, the Building Permit Number and all required reports and consents, the prescribed decision period for a Class 1 or Class 10 building is 10 business days. A residential carport is generally a Class 10a building.
However, that does not mean the entire carport approval process takes 10 business days.
Before that decision period can begin, the project may still require:
site measurements and drawings
structural engineering
Certificate of Title and property information
planning approval, where applicable
Report and Consent from council, where required
approval relating to easements or authority assets
responses to requests for further information
other documents or consents required for the particular property
The Building and Plumbing Commission explains that a building permit application is not considered accepted until the relevant building surveyor has the information required to process it. The statutory decision period also does not commence until the required reports and consents have been received.
For a straightforward carport with complete documentation and no additional approvals, the process can therefore be considerably simpler than a project involving planning controls, boundary variations or an easement.
Builder's tip: Be cautious when someone promises a “10-day building permit.” The 10-business-day period relates to the building surveyor's prescribed decision period once the necessary information and approvals are in place — it is not a guaranteed timeframe from the day you decide to build a carport.
How Much Does a Carport Building Permit Cost in Victoria?
There is no single fixed price for obtaining approval for a carport in Victoria. The total cost depends on the carport design, property conditions and which approvals are required.
When comparing carport quotations, it is important to distinguish between the building surveyor's permit fee and the broader costs involved in preparing a project for approval.
Depending on the project, approval-related costs may include:
building surveyor fees
architectural or drafting plans
structural engineering
Certificate of Title and property information
Building Permit Levy, where applicable
council Report and Consent application fees, where required
planning permit fees, where required
water, sewer or drainage authority applications, where required
additional engineering or documentation requested during assessment
The Building Permit Levy is separate from the building surveyor's fee. Under the current Victorian system, the levy is generally payable where the calculated cost of building work exceeds $10,000. The cost of building work includes relevant labour and material costs and is used to calculate the applicable levy.
The method used to calculate the cost of building work changed from 26 November 2025, so older online information about how the levy is calculated may no longer reflect the current process.
This is why quoting a generic figure such as “a carport permit costs $X” can be misleading. A straightforward carport on an uncomplicated site may have a relatively simple approval pathway, while a project requiring Report and Consent, planning approval or authority consent can involve additional application and professional fees.
Builder's tip: When requesting a carport quote, ask whether the price includes drawings, engineering, building surveyor fees, council applications and other statutory costs. A low initial carport price can look attractive until these items are added later.
